Bylaw - 37. Age restriction
(1) No owner, tenant, or occupant shall:
(a) reside in a strata lot if that owner, tenant, or occupant is under the age of 55; or
(b) permit any person under the age of 55 to reside in a strata lot.

(2) Notwithstanding Bylaw 37(1), an owner who is over the age of 55 may reside in a strata lot with a Spouse who is under the age of 55. "Spouse" means a person who is living and cohabiting with the owner in a marriage-like relationship, including a marriage-like relationship between persons of the same gender, and has lived and cohabited in that relationship for a period of at least 2 years.

(3) Notwithstanding Bylaw 37(1), an owner who is over the age of 55 may permit a Caregiver who is under the age of 55 to reside in a strata lot, provided that the owner, has delivered to the council a written letter from a medical doctor confirming that it is medically necessary for the owner to have a Caregiver. In this bylaw. "Caregiver" means a person who is responsible for attending to the medical, physical, or emotional needs of an owner.
